On Line Health Care Ltd offers this website, including all information, tools and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies and notices stated here.
By visiting our site and/ or purchasing something from us, you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms of Service”, “Terms”), including those additional terms and conditions and policies referenced herein and/or available by hyperlink. These Terms of Service apply to all users of the site, including without limitation users who are browsers, vendors, customers, merchants, and/ or contributors of content.

SECTION 2 – RESPONSIBILTY OF OUR DOCTORS TO PATIENTS
The online nature of this service in no way diminishes the professional obligations that our doctors have for a patient. Our doctors take the same responsibility for each patient as they would if they were seeing a patient in a traditional face-to-face setting. The existence of On Line Health Care Limited as the legal entity behind the MyClinic service in no way seeks to diminish the professional obligations that our doctors owe to a patient.
The material and information available on the MyClinic websites intended for informational purposes only, and does not constitute health or other advice nor should it replace face-to-face consultations with your own family doctor or medical specialist. Please consult a health care professional for specific recommendations about your condition. In addition, the information made available on the MyClinic website changes rapidly and therefore, some of the information may be out of date. You agree to bear all risk associated with the use of or reliance on any such information, and release and hold On Line Health Care harmless from any cause of action that may arise in connection with your reliance on information contained in the MyClinic website.
SECTION 3 – INFORMED CONSENT
You agree that by requesting treatment you formally give your informed consent for our doctors to prescribe that medicine and that you have read the information provided on the MyClinic website about possible side-effects, the effectiveness of the medicine you are requesting and any alternative treatments.
SECTION 4 – YOUR MYCLINIC ACCOUNT
a. You agree that you will not create more than one MyClinic account.
b. You agree that you will not share your MyClinic account username and password with anyone. Furthermore you agree that you will take all reasonable steps to ensure that no third party gains access to your MyClinic account.
c. You agree that you will take all reasonable steps to ensure that any device that you use to set up or access your account is appropriately protected from potential hazards by anti-virus and anti-malware software, firewalls and other such security applications as necessary.
d. You consent for us to contact you by email and telephone if and when the need arises using the contact details you provide in creating your MyClinic account.
SECTION 5 – SCOPE OF SERVICES
Our doctors provide medical services including secure online video consultations for general medical conditions, and a repeat prescribing service for a limited number of conditions. Because MyClinic is not a pharmacy we do not dispense or deliver any medicines.
MyClinic provides a home self-collection blood test and screening service through our accredited partner laboratory.
MyClinic provides a platform for users to access secure online consultations with a range of healthcare professionals, including but not limited to, psychologists and mental health counsellors, physiotherapists, midwives, gynaecologists and nurses.
Registered users have access to their own individual personal electronic healthcare record on the MyClinic website and mobile application.
SECTION 6 – CANCELLATIONS AND REFUNDS
MyClinic will provide a full refund on all prescriptions so long as the request for the refund is made within thirty days of payment and the original signed prescription is returned to us. Refunds will only be made once we have received the original signed prescription.
SECTION 7 - ACCURACY, COMPLETENESS AND TIMELINESS OF INFORMATION
This site may contain certain historical information. Historical information, necessarily, is not current and is provided for your reference only. We reserve the right to modify the contents of this site at any time, but we have no obligation to update any information on our site. You agree that it is your responsibility to monitor changes to our site.
We are not responsible if information made available on this site is not accurate, complete or current. The material on this site is provided for general information only and should not be relied upon or used as the sole basis for making decisions without consulting primary, more accurate, more complete or more timely sources of information. Any reliance on the material on this site is at your own risk.
SECTION 8 – PRESCRIPTIONS MADE BY OUR DOCTORS
You agree that you will read all the information relating to the condition and treatment you are requesting that the doctor has provided you with both online and in printed form.
We take no liability for loss or damage arising from our service or medication prescribed if you supply incorrect or incomplete information.
You agree that you will read the manufacturer’s patient information leaflet that is supplied with the medication before taking any medication that our doctors have prescribed.
You agree that you will follow the advice of the dispensing pharmacist. If the advice of the dispensing pharmacist contradicts the advice of our doctors, you agree that you will contact us for further advice before taking the prescribed medication.
You agree that you will take any prescription provided to you by our doctors to a registered Irish pharmacy to have the prescribed medication dispensed.
You agree that you will not seek to order your medication from an internet pharmacy.
You agree that any medication our doctors prescribe will be solely for your own personal use and that you will not allow any other person to take the medicine.
d. You agree that if our doctors prescribe a medicine and you suffer from any noticeable side-effects, you will contact MyClinic to allow our doctors to fulfil their duty of after-care and to allow them to monitor any complications of treatment that arise.
SECTION 9 - MODIFICATIONS TO THE SERVICE AND PRICES
Prices for our products are subject to change without notice.
We reserve the right at any time to modify or discontinue the Service (or any part or content thereof) without notice at any time.
We shall not be liable to you or to any third-party for any modification, price change, suspension or discontinuance of the Service.
SECTION 10 - ACCURACY OF BILLING AND ACCOUNT INFORMATION
You agree that all information provided by you in availing of services on the MyClinic website will be true and complete to the best of your knowledge and that you will not purposefully omit to provide information that could reasonably be judged to be potentially relevant in providing the service.
You agree that you will not register or complete treatment questionnaires on behalf of anyone other than yourself.
You agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed.
SECTION 11 - OPTIONAL TOOLS
We may provide you with access to third-party tools over which we neither monitor nor have any control nor input.
You acknowledge and agree that we provide access to such tools ”as is” and “as available” without any warranties, representations or conditions of any kind and without any endorsement. We shall have no liability whatsoever arising from or relating to your use of optional third-party tools.
Any use by you of optional tools offered through the site is entirely at your own risk and discretion and you should ensure that you are familiar with and approve of the terms on which tools are provided by the relevant third-party provider(s).

SECTION 13 - PERSONAL INFORMATION
MyClinic has a legal obligation to protect all patient confidential data. We are not allowed to share patient confidential data with third parties, including other doctors, who are unconnected to our service without your explicit consent. To provide this service to patients it is necessary that both our doctors and our non-medical staff have access to patient medical records and patient confidential data. Personal details necessary to process payment with Stripe shall be sent to Stripe as part of the payment process. It is also necessary that for the purpose of maintaining our IT systems, limited access to patient data be made available to our IT contractors. For the purpose of financial audit MyClinic may be required to divulge very limited patient information to our financial auditors and wherever possible information used for the purpose of financial audit will be anonymised. All access to patient information is kept to the minimum required to allow the safe and effective delivery of our services. All patient confidential data is stored electronically on servers owned and managed by IBM Ltd. You have a legal right to obtain any information that we hold about you.
SECTION 14 - ERRORS, INACCURACIES AND OMISSIONS
Occasionally there may be information on our site or in the Service that contains typographical errors, inaccuracies or omissions that may relate to product descriptions, pricing, promotions, offers, dispatch times and availability. We reserve the right to correct any errors, inaccuracies or omissions, and to change or update information or cancel orders if any information in the Service or on any related website is inaccurate at any time without prior notice (including after you have submitted your order).
We undertake no obligation to update, amend or clarify information in the Service or on any related website, including without limitation, pricing information, except as required by law. We are not responsible for failure of third party companies' inability to deliver any prescriptions, blood testing kits or any other product related to the MyClinic service to the correct address or within any particular time or date.
We are not liable for damages which arise from your failure to inform your GP or other healthcare professional about treatment your receive from the website.
SECTION 17 - INDEMNIFICATION
You agree to indemnify, defend and hold harmless On Line Health Care Ltd and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns and employees, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third-party due to or arising out of your breach of these Terms of Service or the documents they incorporate by reference, or your violation of any law or the rights of a third-party.
